Lasting And Enduring Powers Of Attorney
We try to plan for our future as best we can, but life can take many unexpected turns. Lasting Powers of Attorney (LPAs), which have replaced Enduring Powers of Attorney, can go a long way to providing you with peace of mind.
You can express how you wish to be cared for and appoint a trusted friend or family member to handle your financial affairs. The LPA only comes into effect if, for example, you have a serious accident or become too ill to shoulder these responsibilities yourself.
In the same way that a will gives effect to your wishes after you die, an LPA will give effect to your wishes if you become unable to manage your own health and property when you are still alive.
How Do I Get A Power Of Attorney? Financial Powers Of Attorney And Health Powers Of Attorney.
At Potter Owtram & Peck LLP, we encourage all clients to consider making LPAs. If you come to see us about a will, we will explain the advantages of also preparing an LPA if you wish.
We give cost-effective advice on both Financial and Property LPAs and Health and Welfare LPAs. Our solicitors will ensure that you fully understand how they work and in what circumstances they will come into operation. Our prices start at £250 plus VAT and disbursements, e.g., court fees per LPA.
The opportunity to stipulate how you are to be looked after, medically and financially, in the event of illness or serious injury means Lasting Powers of Attorney should be considered by everyone, young and old.
Where there is an existing Enduring Power of Attorney, we can assist in the registration of that document with the court where necessary and advise on other issues relating to Enduring Powers of Attorney.
What Happens If I Do Not Have A Lasting Power Of Attorney?
If you are unable to manage your affairs, your family can ask the Court of Protection to appoint a deputy to act on your behalf.
